XLScout LLC (the “Site”) is an Artificial Intelligence and Machine Learning platform which provides a comprehensive, precise, and intelligent patent and research publication database through its platforms like the Novelty Checker, IdeaCue, Invalidator, TechScaper, Company Explorer, xSDI, and ClaimChart LLM (the “Service/s”). Reference to “You” or “Your” in this policy (the “Agreement”) indicates the user of the Services. You and the Site are sometimes referred to in this Agreement individually as the “Party” and collectively as the “Parties”. This Agreement explains what rights You have with respect to the information and concepts You might generate with the Services or prompts and ideas You might enter into the Services. This Agreement is entered into between the Site and You. It governs Your access and use of the Services and is in addition to the Site’s General Service Terms and Conditions.

This Agreement is effective when You are presented with this Agreement and You proceed to use the Services (the “Effective Date”). These terms may be updated and presented again to You from time to time. Continued use of the Services constitutes acceptance of the updated terms. If You do not agree to this Agreement, please stop using the Services.
By using the Services and agreeing to the terms of this Agreement, You are representing that You are of legal age to enter into a binding contract in Your legal jurisdiction. If You are using the Services on behalf of a business or other entity, You represent that You have the authority to bind them to the terms of this Agreement.

Information collected automatically

1. Your Content

You may provide input including but not limited to corporate information, invention ideas, prompts to the Services (the “Input”), and receive the output generated and returned by the Services based on the Input (the “Output”). Input and Output are collectively called the “Content.” The Services mentioned above operate in the following manner:

Novelty Checker LLM: You may enter Input in the form of ideas which You can make better by supervising the Service and selecting from the variations provided by the Service based on the Input. The Service utilizes processes and tools for inter alia artificial intelligence, machine learning, and natural language processing to work on the Input. Following which it generates Output for You in the form of a novelty report.

Ideacue10x: Based on the Input provided by You to the Service, it will, through processes and tools utilizing a combination of generative AI and inventive concepts, suggest the Outcome to You in the form of inventive idea suggestions which You may utilize to brainstorm and strengthen Your innovation. The service takes the problem statement entered by You in Novelty Checker as input along with machine-suggested inventive concepts.

Invalidator LLM: You may enter Input in the form of a patent number. You can better Your search by supervising the Service which will help it analyze its database. Through processes and tools utilizing AI technology and machine learning it provides You with the Outcome in the form of an invalidation report.

Techscaper: You may enter Input in the form of prompts regarding the area of technology You want to explore. You can streamline your search by supervising the Service and selecting from the classification which will lead to the generation of Outcome in the form of an interactive dashboard.

Company Explorer: You may enter Input in the form of prompts regarding the companies and areas of technology You want to track. You can streamline Your search by supervising the Service and detailing the technologies of Your interest. This will lead to the generation of Output in the form of an interactive dashboard and a competitive intelligence report.

x-SDI (Noise Free Alerts): You may enter Input in the form of prompts regarding the technology sectors and companies You want to track. You may enter detailed Input by training the Service to provide You with the Outcome most suitable to Your requirements. The Service will search and explore its database producing Outcome that You can track and share.

ClaimChart LLM: You may enter input in the form of a publication number. You can select the target companies or add Your targets as well to identify the potentially overlapping products through processes and the use of Large Language Models. You can generate a claim chart report for the overlapping products.

Drafting LLM: Based on your input, it drafts an AI-generated patent application including claims, abstract, background, summary, description, description of drawings and embodiments.

2. Ownership of Content

It is hereby undertaken by the Site that to the extent permitted by the applicable laws, You own all Input. Subject to your compliance with this Agreement, which encompasses the terms and policies of our trusted Service Providers whose tools are employed in rendering the Services, the Site hereby assigns to you all its rights, title, and interest in and to Output. The quality of the Output generated depends upon the sophistication of the Input entered by You. The more detailed Input will automatically result in a more advanced Output. The Output generated will have the capability to provide the first direction to Your innovation journey. You are responsible for the Content, including for ensuring that it does not violate any applicable law or this Agreement.

3. Security of Content

THE INPUT YOU ENTER INTO THE SERVICES GETS STORED ON OUR DATABASE AND ON THE DATABASE OF OUR TRUSTED SERVICE PROVIDERS. THE SITE DOES NOT USE THE INPUT FOR ANY PURPOSES EXCEPT TO PROVIDE YOU WITH AN EFFECTIVE AND EFFICIENT OUTPUT. THE INPUT IS CONTROLLED BY YOU. IT CAN BE PERMANENTLY DELETED BY UTILIZING THE DELETE HISTORY OPTION ON THE SERVICES. UTILIZING THIS OPTION WILL LEAD TO THE PERMANENT DELETION OF THE INPUT FROM OUR DATABASE. The Input You enter is not disclosed to the other users of the Services. The Input is not used to develop or improve our Services. The Output generated based on the Input provided to the Service is shared by the Site in the form of a report only with the user who has put in the corresponding Input. We share Content with a select group of trusted Service Providers, including but not limited to third-party APIs (subject to security and confidentiality obligations) inter alia:
~ The Site may transmit data consisting of the problem statement and system-suggested inventive concept, to the third-party API for idea generation. The site does not use the invention disclosure & invention title for idea generation.

Your Input is handled and shared with responsibility by the Site. The Input shared is modified in a manner so as to ensure that the sharing has no adverse impact on You. You can get updated and detailed information about the data usage practices of these Service Providers from their respective data usage and privacy policies all of which shall be read as being part of this Agreement to the extent of use (by the Site) of the external tools offered by said Service Providers.

For Claim Chart generation, the Site shall retain the Content unless DELETED BY YOU BY UTILIZING THE DELETE HISTORY OPTION ON THE SERVICES. The content is only retained to keep a track of claim chart credits and TO PROVIDE YOU WITH AN EFFECTIVE AND EFFICIENT OUTPUT. YOU CONTROL YOUR DATA. The Content retained by the Site is encrypted to ensure security, integrity, and confidentiality.

4. Security of Site

The Site is hosted by the world’s leading cloud providers whose data centers are certified with the following certifications: (a) ISO 27001 for managing information risks; (b) ISO 27017 for controlling cloud-based information security; (c ) ISO 27018 for protecting personal data; (d) SCO 2 for control over security, availability, and confidentiality; (d) SOC 3 for public report of controls over security, availability and confidentiality; (e) CSA STAR for securing cloud computing environments; (f) PSI DSS for protecting customers’ card information.

5. Similarity of Content

Due to the nature of artificial intelligence and machine learning, Output may not always be unique across users and the Services may generate the same or similar output for users entering Inputs on similar subjects. Responses that are requested by and generated for the user will be their Content and will not be considered the Content of other users of the Service.

6. Restrictions

You shall not (a) use the Services in a way that infringes, misappropriates, or violates any person’s rights; (b) reverse assemble, reverse compile, decompile, translate, or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the Services (except to the extent such restrictions are contrary to applicable law); (c) use the Services to develop foundation models or other large scale models that compete with the Site; (d) use any method to extract data from the Services, including web scraping, web harvesting, or web data extraction methods, other than as permitted through the API; (e) represent that Output from the Services was human-generated when it is not; (f) use the registered and unregistered trademarks, logos, and service marks of the Site or its Service Providers.

7. Third-Party Services

Any third-party software, services, or other products You use in connection with the Services are subject to their own terms, and we are not responsible for such third-party products.

Changes To This Security Policy

This Security Policy is effective as of 1 April 2023 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
